Marriage License Requirements

  •  The premarital physical is no longer required.
  •  Both applicants must come to the office and present valid government issued ID’s.
  •  Marriages performed in the magistrate’s office is by appointment only. Call and schedule appointment @ (252) 430-5119. As of January 1, 2020, the fee was increased to $50.00 to perform a marriage. You will need 2 witnesses with you to witness the marriage.
  • All applicants who have been marriage previously must provide a copy or certified copy of divorce decree or judgement that is signed by the judge or clerk of court. If last marriage ended in death, we need a copy of the death certificate if it’s in state, if out of State of North Carolina we will need to see a certified copy of death certificate. 

Valid ID’s may be one of the following:

  • Valid picture ID or driver’s license (may not be expired).
  • Passport (may not be expired).
  • Military ID (may not be expired).

Social Security Requirements:

  • Both applicants must provide their original social security numbers for verification of the number.  Applicants may present the original social security card, W-2 form or pay stub with the complete number.

Applicants who are not eligible for a social security number may sign an Affidavit attesting to this fact and have it notarized.  Affidavit forms are available in the Register of Deeds office. We do not provide notary services so you will have to seek a notary of choice. 

Applicants aged 21 or older need to present:

  • Valid picture ID’s or driver’s license.
  • Original social security cards.

Applicants aged 18-20 need to present:

  • Valid picture ID’s or driver’s license.
  • Original social security cards.
  • Certified copy of birth certificate.

Applicants aged 16-17 need to present:

  • Valid picture ID’s or driver’s license.
  • Original social security cards.
  • Certified copy of birth certificates.
  • Parents valid ID’s or driver’s licenses.
  • Written consent by parents having full custody or joint legal custody – Custody papers must be presented.

Applicants aged 14-15 need to present:

  • Certified copy of Court Order.
  • Valid picture ID’s.
  • Original social security cards.
  • Certified copy of birth certificates.

Under 14:

  • Unlawful to get married.

 

Fee is $60.00. CASH ONLY.

License is good immediately upon issuance, the license can be used in any county in the State of North Carolina.  It is valid up to 60 days and must be returned to the county in which it was issued. LICENSE IS NOT TO BE USED OUTSIDE OF THIS STATE. 

Marriage licenses are issued Monday – Friday excluding Weekends and Holidays, by appointments only. 

The minister or other person celebrating the marriage is required within 10 days to return the license to the Register of Deeds Office who issued the license.  Failure to do so subjects the person celebrating marriage to a forfeiture of $200.00 to anyone who sues for the same.  You will need a certified copy of the Marriage license to change the name on a driver’s license or social security card.  The cost is $10.00 for a certified copy. Once the ceremony has been performed and the license has been returned to our office you will need to come back or apply by mail to the Register of Deeds office to obtain the certified copy.
