Land Records
Recording Requirements: To record a document, the document needs to be prepared, executed and notarized prior to recording. Deeds and Deeds of Trust require the name of the draftsman on the first page.
The excise or revenue stamp must also be reflected on the front of the deed. Excise tax is calculated at a rate of $2.00 per $1000.00 of purchase price or value of property.
All deeds require the current grantee address on the deed before they can be recorded.
Deeds also require the complete parcel ID # in order for the tax office to place a stamp showing no delinquent taxes owed or the attorney can place a statement stating, the instrument was prepared by (name of attorney) a licensed North Carolina attorney. Delinquent taxes, if any, to be paid by the closing attorney to the county Tax Collector upon disbursement of closing proceeds.
Recording Standards: There needs to be a 3” clear margin at the top of the first page and 1/2-inch clear margin, effective October 1, 2019, around the other 3 sides, one sided, typed or printed in black on white paper in no less than 9 fonts. Blanks in an instrument may be completed in pen. The type of the instrument needs to be stated on the top of the first page below the 3” clear margin. Paper size is 8 ½ x 11 or 8 ½ x 14. If these standards are not met, the Register of Deeds shall record the document after collecting the non-standard fee of $25.00 in addition to the recording fee.
Plats and Condos: Plats and condos prepared by a land surveyor can be recorded. We record plats in 3 sizes, 18×24, 21×30, and 24×36, with a 1 ½ inch border on the left side and ½ inch on the other three sides, on reproducible transparent polyester (Mylar), and a certification stamp from the appropriate review officer if applicable.
If a plat is attached to a document for illustration purposes, it must contain the following language: “This map may not be a certified survey and has not been reviewed by a local government agency for compliance with any applicable land development regulations and has not been reviewed for compliance with recording requirements for plats.” Fees for recording a plat are $21.00 per page. Copies range from $1.00 to $5.00.
Satisfaction: Satisfaction documents are recorded to reflect payment of Deeds of Trust or Mortgages. There are several methods of satisfactions, Trustee Satisfactions, Certificate of Satisfaction, Satisfaction of Security Instrument and Affidavit of Satisfaction. As of October 1, 2011, we will no longer accept the original security instrument and original note to satisfy a Deed of Trust.
G.S. 132-1.10(c), G.S. 132-1.10(f), G.S. 132-1.10(f1) “Any person preparing or filing a document for recordation or filing in the official records may not include a SOCIAL SECURITY NUMBER, EMPLOYER TAXPAYER IDENTIFICATION, DRIVERS LICENSE, STATE IDENTIFICATION, PASSPORT, CHECKING ACCOUNT, SAVINGS ACCOUNT, CREDIT CARD, OR DEBIT CARD NUMBER, OR PERSONAL IDENTIFICATION (Pin) CODE OR PASSOWORDS in the document, unless expressly required by law or court order, adopted by the State Registrar on records of vital events, or redacted so that no more than the last four digits of the identification number is included.”
